TERMS AND CONDITIONS FOR ASTROLOGER/PANDIT/PANDITs:

 This agreement which constitute the Astrologer/Pandit Terms and Conditions, is a legal agreement ("Agreement") between Astrologer/Pandit/Pandit ("You") and Prayfullit in connection with access and/or use the platform for providing on-line advice/services at all websites powered by CB Astrology, or owned by CB Astrology Services Private Limited. The Sites are currently owned and operated by CB Astrology Services Private Limited ("Prayfullit"). This Agreement sets forth and contains the terms and conditions between you i.e. the Astrologer/Pandit/Pandits and Prayfullit. When you sign in as an Astrologer/Pandit/Pandits, you are directly contracting with CB Astrology Services Private Limited by showing your acceptance after clicking on the “I AGREE” button which signifies that the Astrologer/Pandit/Pandits has read the Terms of Service carefully and is bound by the same once your selection as an Astrologer/Pandit/Pandits Advisory is completed with Prayfullit. By using any portion of the website or app you agree to be bound by this Agreement. It is advisable that you should read this Agreement carefully. In the event, if you do not agree to be bound by any clause of this agreement, you should immediately cease from using any portion of the website. Prayfullit solely reserves the right to modify this Agreement any time to comply with law or provision of service or for any other reason solely at the discretion of Prayfullit, which may or may not be separately notified via email. You can determine when these Terms were last revised by referring to 'Last Amended' at the top of these Terms. By signing onto the portal or using any portion of the portal/web/app anytime after the "Last Amended" date, you shall be deemed to have accepted the Terms herein including the amended Terms published from time to time. Your continued use of the Platform following the posting of changes mean that you accept and agree to the changes. However, you are encouraged to check the terms of this Agreement frequently. While you continue to use this Platform, any modifications have been made to this Agreement, would certainly indicate your consent to such modified agreement. By accessing this portal, you agree to read and accept this agreement provided to you in electronic form.

1.0 IMPORTANT DEFINITIONS:

1.1 ASTROLOGER/PANDIT  

You are an "Astrologer/Pandit" if you are selected/appointed/registered as Astrologer/Pandit with the explicit purpose of providing your consultation to the visitors/users of the Prayfullit Platform and/or on partner Sites. Your Astrologer/Pandit Registration/application Form is subject to approval of Prayfullit, once the same is accepted, your profile will be activated by Prayfullit. Rejection of a profile may occur due to incomplete forms/information, or due to lack of experience or incompetency or any other reason that may not have been specifically mentioned here. Any information found incorrect, misleading at any time/duration, your profile, at our sole discretion, shall be subject to rejection without any notice period and Prayfullit may take legal action for such misleading facts.

1.2 MEMBER OR USER OR CUSTOMER

A member or user or customer is one who has registered themselves or applied for availing services on the Prayfullit platform for advice or services from an Astrologer/Pandit. A user may or may not be a paid member. Users can register to avail of free consultation.

1.3 WEBSITE OR PORTAL OR PLATFORM

 Website or portal or platform means all websites/apps owned by CB Astrology Services Private Limited including Prayfullit.com. Prayfullit.com provides various astrology services including "Ask A Question" service. Prayfullit.com also provides a platform wherein Astrologer/Pandit and Users meet for various Astrology services including Vedic astrology, Birth chart, Numerology, Palmistry, Tarot Reading, Aura Reading, Vastu, Spiritual Healing, Online Horoscopes, Chinese Astrology, Western Astrology, Zodiac readings (both Sun and Moon signs), Pooja, Darshan in temples, Matching and more.

1.4 SERVICE

Service includes "Ask A Question" service, phone/call/chat advice service provided through various platforms of Prayfullit. In Prayfullit platform, a user registers himself for availing paid or free advice from registered/appointed Astrologer/Pandit. This Platform allows users to select an Astrologer/Pandit from various Astrologer/Pandit registered therein and ask questions online through chat or voice service. This platform connects the Astrologer/Pandit and User.

2.0 DUTIES TOWARD USER/MEMBER/CUSTOMER:

2.1: You will provide true and accurate information Astrology qualifications, expertise, skills, degrees, background and will maintain and update all such information during the term of this Agreement to keep it true. You will not present misleading names/qualifications.

2.2: You will not perform/offer services/advice in any jurisdiction where you are not authorized or qualified or licensed or which is outside your expertise. You will not mislead Users to believe that you can provide such services which are outside your expertise or for which you are not licensed.

2.3: You will not advise any remedy, treatment, test, that requires an in-person physical examination of a User.

2.4: You will advise users that your advice can not be a substitute for the advice of a physician and that your advice is for informational purposes only and it cannot be substitute for it.

2.5: You will not provide any advice related to any matters like medical or legal which can be provided by only a qualified medical or legal expert.

2.6: You will not take any actions which may hamper, slow down, or manipulate the integrity of this portal/Site.

2.7: You will not transmit/communicate through the Site/portal any unlawful, bullying, defamatory, privacy violative, insulting, intimidating, derogatory, vulgar, indecent, racist, destructive or otherwise offensive/objectionable material of any kind.

2.8: You will not stalk, intimidate or harass any Astrologer/Pandit or User or infringe upon or attempt to violate upon their privacy.

2.9: You will not violate any applicable local, national, or international law of any kind.

2.10: You will not attempt to contact the User for any sort of payment or fee.

2.11: You will not exchange any personal contact information with any User for any purpose, which may include making offline payment or in-personal meetings.

2.12: You will not attempt to take the act for providing offline/online advice with any user provided by this portal other than use of this portal.

2.13: You will not attempt to fraudulently increase talk/chat time with User which would result in a greater payment to you.

2.14: You will be agreed to all performance ratings and reviews given by the User after availing services from you. And agree to display such ratings/reviews on Prayfullit Platform to the public. You also understand that Prayfullit has nothing to do with such ratings/reviews. If Astrologer/Pandit finds any review harsh, offensive, objectionable it may bring it to Prayfullit knowledge for moderation.

2.15: You will not advise on matters/games related to gambling.

3.0: ADDITIONAL TERM & CONDITIONS FOR 'ASK A QUESTION' SERVICE All:

Terms & Conditions given in this agreement apply to Astrologer/Pandit while answering or registering for providing "Ask A Question" Service. Below are additional Term & Conditions while answering "Ask A Question" Service.

3.1: You agree that you will reply to every query with a maximum turnaround time of 6 hours.

3.2: You agree that you will adhere to the format of the model answer.

3.3: Your writing should be your own words and should be free from plagiarism.

3.4: You need to provide detailed invoices at the end of the payment cycle which must contain the number of leads served date wise.

3.5: Queries will be sent on all 7 days of a week. You should also be ready to work in weekend (Sat & Sun)

3.6: If you will not be able to work on any day, then you will have to inform us well in advance.

4.0 DUTIES TOWARD PORTAL/WEBSITE/PLATFORM:

4.1: You understand that the service provided by you are exclusive to this Platform. Subject to term and conditions of this agreement, you grant an exclusive right and license of your services to be used in the platform. Anytime during the term of this agreement, if you found to be providing any similar service at any other platform, then Prayfullit at its sole discretion may reduce your agreed rate/fees or may terminate your services from the platform.

4.2: You will not indulge in any act which results in any intellectual property violation, spread of viruses, worms, malicious software, or any other illegal or immoral act.

4.3: Prayfullit Portal reserves the right in its sole discretion to review the activity & status of each account & block the account of an Astrologer/Pandit.

4.4: You will receive alerts/SMS notifications including daily reminders from Prayfullit for provision of service.

4.5: You will abide by the payment/pricing guidelines.

4.6: You agree to a fair price policy and can set prices according to the policy of Prayfullit. Prayfullit reserves the right to change your price as per its internal policy without informing you. if you violates this provision, Prayfullit reserves the right to disable the services of the Astrologer/Pandit without prior notice.

4.7: You will not share access to this platform with anyone else. You will not share the user id / password or any other credential with any other person.

4.8: You acknowledges that Prayfullit merely provides a platform wherein the You can meet the Users, i.e. customers/Members and therefore agrees that the Site/portal are being provided for use as is, and therefore, the Astrologer/Pandit will not have any plea, claim, or demand vis a vis . Further, the use of and/or the Sites by the Astrologer/Pandit is voluntary and completely at your sole and entire risk, without any warranty of merchantability, fitness for a particular purpose, non-infringement, compatibility etc.

4.9: The management will be at liberty to dispense with your services at any time without notice or payment of any compensation and without assigning any reasons whatsoever.

4.10: You understand that Prayfullit promotes the Astrologer/Pandit profiles through various digital and social media platforms. Prayfullit shall have the right to use Astrologer/Pandit profile picture, video, content, ratings, reviews and description for promotional and advertising purposes. Additionally, any pictures and videos of the Astrologer/Pandit provided by the Astrologer/Pandit or captured by Prayfullit, either directly or during live sessions, may also be used for promoting and advertising Prayfullit services & Products.

4.11: You understand that all chats and phone consultations with customers of the Website will be recorded for quality assurance purposes. With prior agreement from You, Prayfullit reserves the right to observe such conversations and consultations for monitoring purposes.

4.12: The Astrologer/Pandit hereby undertakes not to upload, publish, email, send, or in any way disseminate any content on or through Prayfullit that is illegal, detrimental, menacing, abusive, harassing, tortious, slanderous, indecent, obscene, defamatory, invasive of someone else's privacy, hateful, or that exhibits racial, ethnic, or any other form of objectionable characteristics.

5.0 PREDICTIONS:

5.1: Astrologer/Pandit understand that this is an astrology platform and only astrology services are provided through this platform. Astrologer/Pandit is responsible for all predictions/advice made by the Astrologer/Pandit. Astrologer/Pandit understand and agrees that he will not make any prediction which is unlawful/illegal or against any law. Astrologer/Pandit must refrain from advising below mentioned list of prediction/advice, which is not exhaustive. Predicting the gender of the unborn child. Providing date/time for medical issues such as an operation for successful completion. Prediction with regard to any criminal offence being planned by the customer. Prediction with regard to achieving success through illegal means. Predictions relating to gambling, money - laundering, drug abuse etc. Predicting with regard to ensuing death for any reason whatsoever inclusive of accidental, medical, etc.

6.0 DISCLAIMER:

6.1: Prayfullit is not responsible for any incorrect or inaccurate content posted on the Website or in connection with the Service, whether caused by users of the Website, Astrologer/Pandit Service Providers or by any of the equipment or programming associated with or utilized in the Service.

6.2: Prayfullit assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of communications.

6.3: Prayfullit is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Website or combination thereof, including injury or damage to users and/or Astrologer/Pandit or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service.

6.4: Under no circumstances will Prayfullit or any of its affiliates, advertisers, promoters or distribution partners be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Website or the Service, any Content posted on the Website or transmitted to Astrologer/Pandit, or any interactions between users of the Website, whether online or offline.

6.5: The Website and the Service are provided "AS-IS" and Prayfullit Portal expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Prayfullit Portal cannot guarantee and does not promise any specific results from use of the Website and/or the Service.

6.6: Any information may be posted on the Prayfullit Portal for informational purposes only and is not intended to replace or substitute for any professional financial, medical, legal, or other advice.

6.7: Prayfullit Portal makes no representations or warranties and expressly disclaims any and all liability concerning any treatment, action by, or effect on any person following the information offered or provided within or through the Website.

6.8: If any user of the website has specific concerns or a situation arises in which he requires professional or medical advice, he should consult with an appropriately trained and qualified specialist.

6.9: Prayfullit does not promote or encourage any superstition like Tantra, Black Magic, Totke, Vashikaran etc. Astrologers are advised to provide simpler remedies to the customer seeking advice. Any advice which is directly relatable to any loss or danger of life be it animal or human being shall be viewed as a gross violation of the terms and conditions.

7.0 PAYMENT OF FEES AND BILLING AND FINE:

7.1: Revenue received will be shared between Astrologer/Pandit and Prayfullit at an agreed rate separately intimated to the Astrologer/Pandit. Therefore, before making the payment to the Astrologer/Pandit, Prayfullit shall be entitled to deduct the amounts which have accrued to it and the remainder shall be transferred to the Astrologer/Pandit, as agreed by the Astrologer/Pandit at the time of registration.

7.2: You understand that Prayfullit may reduce/change the agreed Astrologer/Pandit rate to promote the platform or to give discount offers to its customers or for any other reason, in its sole discretion, without informing the Astrologer/Pandit. However, the changed rate will get displayed in the Platform against the respective name of the Astrologer/Pandit.

7.3: Astrologer/Pandit understands that no payment shall be made for any free minutes, discount, coupon, voucher, ticket offered to customer for promotional purpose.

7.4: You understand that Prayfullit shall be entitled to deduct monthly software maintenance charges i.e Rs. 179 each month from your share of overall revenue earned from Prayfullit. However, no deduction shall be made for a particular month in which your share of revenue does not exceed Rs. 4500 in any month.

7.5: All payments to be made to Astrologer/Pandit are after deduction of TDS as per Income Tax Act. 1961. Astrologer/Pandit agrees that TDS will be deducted from any payment made to Astrologer/Pandit irrespective of amount or monetary limit. Payments are to be made within 10 days of the following month in which revenue has accrued subject to public holidays or conditions beyond the control of Prayfullit.

7.6: Prayfullit's billing system is not error-free, and shall not be liable for any problems, miscalculations or malfunctions in processing Astrologer/Pandit Fees or other payments due to the Astrologer/Pandit. Astrologer/Pandit can inform of such mistakes within 48hours of discovery of such mistakes.

7.7: If for any reason the Member has paid but later charged back/cancelled such payment/order, no Astrologer/Pandit Fees will be paid to the Astrologer/Pandit for that transaction and if the money has already been sent to the Astrologer/Pandit, Astrologer/Pandit is required to repay this amount to Prayfullit, and Prayfullit has the right to deduct this amount from the Astrologer/Pandit's account or from the following payments to be made from Prayfullit to Astrologer/Pandit.

7.8: Any Astrologer/Pandit advice that is disputed, and remains unresolved, will be withheld for a reasonable amount of time till the problem is resolved. Prayfullit will have the final say with regards to disputes in this regard.

7.9: Astrologer/Pandit agree and declare that if the customer is not satisfied with the services provided by you inclusive of wrong predictions being made or the service could not be rendered due to internet issue or other reasons, the Prayfullit may at its own discretion, refund all or partial amount to the customer, for which no payment is to be made to the Astrologer/Pandit.

8.0 USERNAME AND PASSWORD:

8.1: When you, the Astrologer/Pandit, create and open an account with, you will be asked to provide a username and password. You are entirely responsible for maintaining the confidentiality of your password and username and any other security information related to your account.

8.2: You will be fully responsible for all activities that occur under your account, username or password. You may not use the account, username or password of someone else at any time. You will immediately notify of any unauthorized use of your password, username, e-mail or any other breach of security.

8.3: Prayfullit encourages Astrologer/Pandit to change their password at least once a month. Prayfullit will not be liable for any loss that you incur as a result of someone else using your account or your password, either with or without your knowledge. You may be held liable for any losses incurred by Prayfullit due to someone else's use of your account or password.

9.0 INTELLECTUAL PROPERTY:

9.1: Prayfullit owns and retains all Intellectual Property Rights of the Prayfullit Portal and as explained above, retains an exclusive license to the contents added and uploaded by you on the site. The Prayfullit Portal contains the copyrighted material, trademarks, and other proprietary information. You shall not copy, publish, transmit, distribute, or sell any such proprietary information.

9.2: Opinions, statements, or content made available through the Service by Astrologer/Pandit, are those of the Astrologer/Pandit, and should not necessarily be relied upon. Such Astrologer/Pandit are solely responsible for putting such content and not Prayfullit Portal and it does not guarantee accuracy, completeness or usefulness of such information. Prayfullit Portal does not endorse or accept responsibility for opinions, contents, and statements, comment made by Astrologer/Pandit that appear on website. Under no circumstances will Prayfullit Portal or its affiliates be responsible for any loss or damage resulting due to the content posted/transmitted on the Website by any body as Prayfullit Portal does not authenticate, investigate or does background check of the information which is uploaded on Prayfullit’s portal.

10.0 COPYRIGHT POLICY:

10.1: Astrologer/Pandit acknowledges that they will not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information of Prayfullit Portal without obtaining the prior written consent from Prayfullit.

10.2: All vested contingent and future intellectual property rights in Prayfullit Portal including but not limited to copyright, trademark, service marks, design rights (whether registered or unregistered), patents, knowhow, trade, secrets, inventions, database rights and any applications for protection or registration of these rights and all renewals and extensions there of existing in any part of the world whether now known or in the future shall remain with the Prayfullit.

11.0 LIMITATION ON LIABILITY AND INDEMINITY:

11.1: Astrologer/Pandit acknowledges that in no event shall Prayfullit Portal be liable for any damages whatsoever, whether direct, indirect, general, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of Astrologer/Pandit or anyone else in connection with the use of the Prayfullit Portal., including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered Astrologer/Pandit of this service or persons met through this service.

11.2: Astrologer/Pandit agree to take reasonable precautions in all interactions with other members of the service, particularly if the user decides to meet offline or in person.

11.3: Astrologer/Pandit should not provide your confidential information (for example, credit card or bank account information) to other members.

11.4: Provided that notwithstanding anything to the contrary contained herein, Prayfullit liability to Astrologer/Pandit for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by Astrologer/Pandit to Prayfullit Portal for the usage during the term of Agreement in force.

11.5: Astrologer/Pandit acknowledges and agrees that Prayfullit disclaims any liability with respect to any claim, suit or action brought by a member in connection with provision of any services by Astrologer/Pandit (including, without limitation, representations by the Astrologer/Pandit as to Astrologer/Pandit's qualifications and advice provided by the Astrologer/Pandit) through the Prayfullit service and Astrologer/Pandit agrees to indemnify and hold Prayfullit harmless in connection with any such claim and any damages or expenses arising therefrom.

11.6: Astrologer/Pandit undertake to defend, indemnify and hold harmless the Website and its affiliates, directors, employees and other officers against any claims, liabilities, actions, proceedings, demands, expenses etc. made by a third party, including statutory authorities, which the Website may incur or suffer in connection with any proceeding arising out of.

i. The use of the platform by Astrologer/Pandit.

ii. Any unauthorised use and violation of the profile created and managed by Astrologer/Pandit on the Website.

iii. Any Prediction/advice given by Astrologer/Pandit.

iv. Any acts or omissions, negligence, misrepresentation, fraud and/or misconduct by Astrologer/Pandit.

12.0 NON-DISCLOSURE CLAUSE:

12.1: The Astrologer/Pandit acknowledges and agrees that it shall be solely responsible for all conduct, services, advice, postings and transmissions that are made from the account of the Astrologer/Pandit and further consents that any information or content that the Astrologer/Pandit posts or transmits will not be considered to be Astrologer/Pandit's confidential information and in fact, this information, whether personal in nature or not, shall be owned by Prayfullit.

12.2: Astrologer/Pandit further agrees and consents to all conversations, chats or transcripts being captured in any format controlled, processed and shared by Prayfullit in terms of the Privacy Policy and as permissible by law.

12.3: The Astrologer/Pandit however does warrant that any information shared by the member/User to the Astrologer/Pandit will not be disclosed and will use his/her best efforts to guard member's privacy.

12.4: Astrologer/Pandit will not share access to the Astrologer/Pandit management platform with anyone else. You will not disclose terms and conditions between Prayfullit and the Astrologer/Pandit to a third party or to a member of Prayfullit. Any disclosure will be deemed to be a violation of confidentiality and can result in an Astrologer/Pandit being asked to leave the platform.

12.5: You will not at any time disclose or divulge into any one in any form, documentary or otherwise any information or particulars or details of any trade or business or any other matters connected therewith or any trade secrets or processes which may come to your knowledge while you are working for the Company and you will always keep secret all information in respect of the Company.

13.0 JURISDICTION AND DISPUTE RESOLUTION:

13.1: Any question or difference which may arise concerning the construction meaning or effect of this Agreement or concerning the rights and liabilities of the parties hereunder or any other matter arising out of or in connection with this Agreement shall be referred to a single arbitrator who shall conduct proceeding in Jaipur which shall be appointed by Prayfullit.

13.2: The decision of such arbitrators shall be final and binding upon the parties. The cost of proceedings shall be borne equally by the parties. Any reference under this clause shall be deemed to be a reference to arbitration within the meaning of the Arbitration Act 1996. The courts at Jaipur at Rajasthan (India) shall have exclusive jurisdiction in all the matters arising out of Agreement. For the purpose of Jurisdiction this Agreement shall be deemed to be accepted by the Astrologer/Pandit at Jaipur.

14.0 TERMINATION:

14.1: Prayfullit at its sole discretion may terminate this agreement without giving any reason with immediate effect by giving you a written notice to your registered mail id and remove your profile from the App/Web.

14.2: Astrologer/Pandit may terminate this Agreement only after providing the Company a written notice of at least 30 days prior to his intention to terminate. It is hereby clarified that during such notice period, the Astrologer/Pandit shall be obligated to render the Services, he/she has been engaged to render under this Agreement at the same level of service conditions as stipulated in this Agreement and shall not deteriorate the level of service quality in any manner. The Astrologer/Pandit will mandatorily be required to serve the notice period, unless waived by the Company at its sole discretion. Astrologer/Pandit while serving notice period Astrologer/Pandit cannot work or join any other astrology platform. Astrologer/Pandit must complete 90 login hours while serving the 30 days' notice period. Knowingly he should not avoid any call/chat while serving the notice period. Astrologer/Pandit further agrees that Astrologer/Pandit's whole earning will be forfeited on violation of this clause. It is further informed that whole earning will be forfeited even if partial notice days/login time is served.

14.3: No payment will be made to an Astrologer/Pandit serving his notice period till the full and final settlement. Full and final settlement includes completion of 30 days' notice period and completion of all other formalities of termination as mentioned in clause 14.2. Any payment due to such Astrologer/Pandit till full and final settlement will remain on hold.

14.4: You agree that even after termination of this agreement, or during the term of this agreement, you will not contact any Prayfullit customers, whether or not you had earlier consulted with them during the term of this agreement. Prayfullit may take legal action for any violation of this clause.

14.5: You understand that Prayfullit uses its Astrologer/Pandit name, pics, video and other information for promotional purposes, and such information will get published in multiple pages of Prayfullit web/app, it is not practical to remove the videos/pictures from all locations and it may display even after the end of term of this agreement.

15.0 FINE AND PENALTY:

15.1: You will provide true and accurate information related to your qualifications, expertise, skills, degrees, background, and photograph and will maintain and update all such information during the term of this Agreement to keep it true. You will not present misleading names/qualifications/photographs/Videos. Any information found to be misleading, illegal or wrong, a penalty of Rs. 11,000/- shall be imposed and your profile shall be deactivated immediately without informing you.

15.2: You should treat the customer who contacts you through Prayfullit with respect. Any use of filthy language, threats, or similar behaviour will result in the cancellation of your Prayfullit profile for a minimum of three (7) days and a penalty of Rs. 11000/- to reactivate your profile. The parties have also agreed that the 7-days period might be prolonged till the penalty is paid. You also agree that it is the discretion of the Prayfullit compliance team to decide what is disrespectful to the customer after giving Astrologer/Pandit equal opportunity of being heard. You must maintain proper decorum and answer all of the customer's queries in a calm manner. You undertake not to upload the customer's personal information or display the reason or purpose for seeking counsel from you anywhere on the internet or any other platform. Any complaint received in this situation will result in your profile being deactivated without warning.

15.3: You agree not to disclose your real name/Full name/alias name to any customer being assigned to you for consultation. You shall be using only the display name provided to you by Prayfullit for any communication taking place at the platform either in the form of phone consultation, review, comments, etc. Violation of this clause will attract the deactivation of your profile without any warning issued and a fine of Rs. 11,000/- by the Compliance team at Prayfullit. Furthermore, Prayfullit verified Badge shall be removed on violation from your profile. Furthermore, Prayfullit verified Badge shall be removed on violation from your profile.

15.4: You must not share any personal information about yourself, your friends, acquaintances, family members, or anybody else with whom you may or may not be associated. Contact numbers, bank account numbers, e-mail addresses, websites, personalized pages, blogs, and social media profiles [including but not limited to Facebook, Instagram, WhatsApp, Telegram, Messenger, SMS, and others] with any consumer seeking help are all examples of personal information. You also do not induce customers for offline meetings. A customer should also not share any such personal information and if the customer does it so, it is your responsibly to report such matter to the company immediately and not to contact customer. A penalty of Rs. 11,000/- INR will be imposed if this condition is violated and the account will be temporarily deactivated. Furthermore, Prayfullit verified Badge shall be removed on violation from your profile.

15.5: It is suggested that you offer the customer seeking help easier solutions. Any advice directly related to any loss or danger of life, whether animal or human, would be considered a gross violation of the terms and conditions. A penalty of Rs. 1,00,000/- would be imposed for any infringement of this condition and the account will be temporarily deactivated. Furthermore, Prayfullit verified Badge shall be removed on violation from your profile.

15.6: You agree not to do anything that could harm Prayfullit's reputation or interests, such as posting negative reviews on any social media platform, disclosing the company's policies to anyone, or making any defamatory comments of any kind or nature about the Company, its employees, officers, directors, agents, consultants, affiliates, and so on. You should also not indulge in any such act, like giving negative comments/reviews, which negatively impact other Astrologer/Pandit working in this platform. You also agree that you will not encourage, motivate, or convince any of your friends, family members, clients, acquaintances, or anyone else to do the same. A penalty of Rs. 11,000/- INR would be imposed for any infringement of this condition. Furthermore, Prayfullit verified Badge shall be removed on violation from your profile.

15.7: By registering with Prayfullit, you promise not to work or deliver your services on any competing platform that provides identical services via the internet. You may not use a fictitious or alias name while attempting to provide services (similar to those provided at Prayfullit) on any competitor platform via the internet. Violation of this clause will attract the deactivation of your profile without any warning issued. A fine of Rs. 11,000 may be imposed by the compliance team at Prayfullit and all your earning will be forfeited.

15.8: The compliance team shall review each of the violations mentioned in clause 15, on being found guilty, the penalties mentioned therein shall be charged. To re-activate the Prayfullit verified Badge Rs. 11,000/- shall be charged from the Astrologer/Pandit. To recover the penalty earning may be forfeited.

15.9: The Astrologer/Pandit agree that he will serve the promotional calls in a cordial manner with the same passion and eagerness that he would exhibit in any other paid call and treat all customers with respect. Knowingly he will not cut/avoid any promotional/free call. A fine of Rs. 11,000 may be imposed by the compliance team at Prayfullit on violation of this clause. Furthermore, Prayfullit verified Badge shall be removed on violation from your profile.

15.10: Astrologer/Pandit understands that by giving more time to the platform, it increases the chances for more call/chat count and leads to more income. The platform encourages the Astrologer/Pandit to give a minimum 3 hours in a day and 90 hours in a month. A fine of Rs. 11,000 may be imposed by the compliance team at Prayfullit on violation of this clause. Furthermore, Prayfullit verified Badge shall be removed and profile may be disabled on violation.

15.11: Prayfullit may at its sole discretion disable the profile of Astrologer/Pandit permanently or temporarily without giving any notice. Prayfullit may also update/modify or remove the features from Astrologer/Pandit profile at its sole discretion without giving any reason thereof. In the event of any conflict or inconsistency with other provisions of this agreement, this clause shall take precedence.

15.12: The service charges are predefined by Prayfullit. Prayfullit retains the right to deduct service fees, processing fees, GST, or any other applicable charges on the services provided by you through Prayfullit. Both parties agree that a standard service fee of 20% will be deducted by Prayfullit from the amount payable to you for the services rendered through Prayfullit. It is your responsibility to generate an invoice for the services provided via the Prayfullit platform. Failure to do so will be construed as acceptance of the amount due and payable to you.

15.13:              i. No-show: In case of a no-show by the Pandit for a scheduled puja at the customer's  place, the following penalties will apply:

      First instance: Rs. 5,000 fine and a written warning.

   Second instance: Rs. 10,000 fine and temporary suspension of profile.

Third instance: Rs. 15,000 fine, profile deactivation and review for termination.

ii. Late Arrival: If the Pandit arrives late for a scheduled puja at the customer's place:

      Delay up to 30 minutes: Rs. 1,000 fine.

   Delay exceeding 30 minutes: Rs. 2,000 fine.

   Subsequent delays: Incremental fines of Rs. 1,000 for each additional 30 minutes.

     Persistent tardiness may lead to profile suspension or deactivation.

iii. Failure to Follow Puja Format: If the Pandit fails to perform the puja as per the prescribed format:

First instance: Written warning and counseling session.  

Second instance: Rs. 5,000 fine and retraining requirement.

Third instance: Rs. 10,000 fine, profile suspension, and mandatory retraining.

16.0 SEVERABILITY:

16.1: The Parties agree that if any of the provisions of this Terms shall be held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the other remaining provisions of this Terms shall remain in full force and effect.

16.2: On such a clause being declared or determined as unlawful or unenforceable, the same shall stand removed from this Terms while the other Clauses shall have no adverse effect in the case of such clause being declared as unlawful or unenforceable.

17.0 NO SHOW AT DARSHAN LOCATION:  

First instance: Rs. 5,000 fine and a written warning.

Second instance: Rs. 10,000 fine and temporary suspension of profile.

Third instance: Rs. 15,000 fine, profile deactivation, and review for termination.

18: Contact Information We store your up-to-date contacts in order to notify you as soon as one of your contacts signs up for Only Astrologer/Pandit login and to properly display names in notifications. We only need the number and name (first and last) for this to work and store no other data about your contacts.

19: Why We Collect Your Phone Number:

A. Telephonic Calling: Your phone number enables you to make and receive telephonic calls. This feature is designed to facilitate real-time conversations and interactions with other users.

B. Chat Alerts: We use your phone number to send important alerts and notifications related to your interactions on the platform.

C. One-Time Password (OTP) Verification: To enhance the security of your account, we implement OTP verification for specific actions, such as login, account recovery, and sensitive updates. Your phone number sends you a unique OTP that helps verify your identity and protect your account.

20: Your Privacy Matters to Us We want you to know that we value your privacy and take your data seriously. Your trust in us is essential, and we're committed to protecting the information you share with us.

21: How Your Data is Used The data we collect depends on how you use our app. Our app involves telephonic conversations, and we ask for permission to access your call logs. This helps us ensure that your conversations on the app go smoothly.

22: Why We Need Call Log Permission Seamless OTP Verification via Missed Call. OTP verification method using missed calls. Show the app interface with the "Get otp on call" button for OTP verification. simply tap on the 'Get otp on call' button for OTP verification. Demonstrate tapping on the "Get otp on call" button and initiating the call. "A call is instantly triggered, delivering the OTP in a matter of seconds. Note: the call OTP only work for the same phone and with sim in it.

23: Voice Recording and Microphone Permission

23.1: In our app, we've implemented a unique and convenient way for you to ask questions and interact with us in your chat — by recording your voice as audio. Instead of typing out your queries, you also have an option to simply speak into your device's microphone, record the voice as audio, and then send it on chat. This audio interaction feature is designed to make using our app more intuitive and in tune with natural communication.

23.2: To enable you to record your questions and thoughts in your own voice as audio, we need to request access to your device's microphone. When you grant us this permission, it allows our app to capture the sound of your voice as audio and convert it into digital data that we can process.
